By accessing or using the website www.liveaffetto.com (the “Site”) and any associated digital services, you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all purchases, site visitors, and users of products sold by Live Affetto LLC (“Affetto,” “we,” “us,” or “our”). 

Your use of the Site is also governed by our [Privacy Policy] and other posted policies (collectively, the “Policies”). If you do not agree to these Terms, please do not use the Site or purchase products from us. 

1. Eligibility & Use of Site 

By using our Site, you represent that you are at least 18 years old and legally capable of entering into binding agreements. You may not use our Site or products for any unlawful or unauthorized purpose.  

2. Products & Health Disclaimer 

Our products—including cold plunges, saunas, red light therapy devices, and PEMF mats—are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease. Always consult your physician or qualified health provider before starting any wellness program or using these devices, particularly if you are pregnant, have a medical condition, or are sensitive to heat/cold/light exposure.

3. Orders & Payment 

We reserve the right to refuse, limit, or cancel orders at our sole discretion, including orders that appear to be placed by resellers or distributors. If your order is canceled, we will attempt to notify you using the email or billing address provided. 

All prices are listed in U.S. dollars and are subject to change. Payment is required at checkout, and your purchase is not confirmed until full payment is received. 

4. Shipping, Delivery & Risk of Loss 

Shipping timelines provided are estimates only and may vary based on availability, production lead times (particularly for made-to-order products), and shipping location. Risk of loss and title pass to you upon delivery to the carrier. 

For international orders, you are responsible for all customs, duties, taxes, and compliance with local laws. 

5. Returns, Refunds & Cancellations 

Please refer to our [Return & Refund Policy] for detailed information. Certain products—including cold plunges, PEMF mats, and custom orders—may be final sale or non-returnable due to hygiene, customization, or size. 

We reserve the right to refuse returns that do not comply with our policy. 

6. Warranties & Disclaimers 

Manufacturer Warranties: 
Some products sold by Affetto are covered by third-party manufacturer warranties. We will make reasonable efforts to facilitate warranty claims but are not responsible for third-party warranty fulfillment. 

Affetto Warranties (if applicable): 
If we offer our own warranty on a product, warranty coverage and exclusions will be stated clearly at the time of purchase. 

General Disclaimer: 
ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 

We do not warrant that your use of the Site or products will be uninterrupted, timely, secure, or error-free. 

7. Limitation of Liability 

To the fullest extent permitted by law, Affetto and its affiliates, officers, directors, employees, agents, and contractors shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of the Site, products, or services, including but not limited to personal injury, property damage, or loss of profits. 

Our total aggregate liability shall not exceed the amount paid by you for the specific product giving rise to the claim. 

8. Intellectual Property 

All content on the Site—including text, graphics, logos, product names, and images—is the property of Live Affetto LLC or its licensors and protected under U.S. and international intellectual property laws. You may not reproduce, duplicate, copy, sell, or exploit any part of the Site without express written permission. 

All trademarks of third-party brands or manufacturers remain the property of their respective owners. 

9. User Accounts 

If you create an account, you are responsible for maintaining its confidentiality and restricting access to your device. You agree to accept responsibility for all activities that occur under your account.

You may not use the Site or products for any unlawful purpose or in any way that could harm, disable, or impair the Site or interfere with any other party’s use.

We may provide links to third-party websites for your convenience. We are not responsible for the content, privacy policies, or practices of any third-party sites. 

12. Governing Law & Dispute Resolution 

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. 

Arbitration Clause: 
Any disputes arising from your use of the Site or purchase of products shall be resolved by confidential binding arbitration in Pensacola, FL, pursuant to the rules of the American Arbitration Association. You waive your right to a jury trial and to participate in class actions.

You agree to indemnify, defend, and hold harmless Live Affetto LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, products, or breach of these Terms.

By using the Site or communicating with us electronically, you consent to receive communications from us electronically. These may include emails, notices, or updates posted on the Site. 

15. Modifications to Terms 

We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Site after any changes constitutes acceptance of the new Terms. 

16. Severability 

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be deemed severed and shall not affect the validity and enforceability of any remaining provisions.
